Overview

The Clean Water Infrastructure Act of 2017 invests $2.5 billion in clean and drinking water infrastructure projects and water quality protection across New York. As part of the Act, the New York State Intermunicipal Water Infrastructure Grants Program (IMG) authorized the New York State Environmental Facilities Corporation (EFC) to provide at least $150 million in grants to assist municipalities in support of intermunicipal water quality infrastructure projects. IMG grants are available for both drinking water and sewage treatment works (clean water) projects that serve multiple municipalities, such as a shared water quality infrastructure project or the interconnection of multiple municipal water systems. Cooperating municipalities with an eligible project may be awarded an IMG grant up to $10 million or 40% of net eligible project costs, whichever is less.

Eligibility

Municipalities, including any county, city, town, village, district corporation, county or town improvement district, school district, Indian nation or tribe recognized by the state or the United State with a reservation wholly or partly within the boundaries of New York State, any public benefit corporation or public authority established pursuant to the laws of New York or any agency of the State that is empowered to construct and operate a water quality infrastructure project. A school district is eligible to apply for an IMG grant and DWSRF financing assistance, but is ineligible for CWSRF financial assistance.

Municipally-owned sewage treatment works projects OR municipally-owned public water system projects that construct, replace, or repair infrastructure, or for compliance with environmental and public health laws and regulations related to water quality.

Each project must meet the following criteria:

  • Include construction services.
  • Have not closed on an SRF financing.
  • Have not started construction before October 1, 2017.
  • May not be for the construction of water infrastructure that exclusively supports new development, whether residential or commercial.
Evaluation Criteria

In evaluating projects, EFC and DOH will consider factors such as the water quality improvement or reduction in risk to public health, readiness to advance construction, level of demonstrated community support, and the benefits to multiple municipalities. 

Requirements

EFC is committed to promoting participation opportunities for New York State ("State") certified minority- and women-owned business enterprises ("MWBEs") and federal disadvantaged business enterprises ("DBEs"), and equal employment opportunities ("EEO") for minority group members and women in the performance of EFC contracts as well as contracts that receive financial assistance through EFC's various programs.

The State Smart Growth Public Infrastructure Policy Act of 2010 is intended to augment the state's environmental policy by maximizing the social, economic, and environmental benefits of public infrastructure development while minimizing unnecessary environmental degradation, disinvestment in urban and suburban communities, and the loss of open space resulting from sprawl development.

The utilization of iron and steel products that are produced in the United States is required for construction, alteration, maintenance, or repair of public water systems or treatment works funded wholly or in part by SRF financial assistance.

Requirements regarding prevailing wages, hours of work, and rates of pay are required for contracts in excess of $2,000 and is funded wholly or in part by SRF financial assistance.
